How should trucking companies handle an accident claim?

Few situations are as distressing as learning that one of your fleets has been involved in an accident, especially if someone was hurt as a result. If the injured parties are seeking compensation for their damages, it is vital to tread carefully in deciding your next steps.

Your approach to resolving the situation—whether through negotiation or gearing up for a courtroom battle—can significantly impact your company’s future. Here are some key considerations to keep in mind as you proceed.

Did you receive a demand letter or a complaint and summons?

Receiving a demand letter might be nerve-wracking, but it also presents an opportunity to resolve the matter before it escalates into a lawsuit. These letters typically outline the accident in detail, explain why the sender believes the other party is at fault, and include a list of damages and the compensation sought. By engaging in open communication and offering a reasonable settlement, you may save your company from costly and time-consuming litigation.

Alternatively, if you received a summons, then the other party has filed a complaint against your company and has initiated legal action. It does not mean you have to prepare for court just yet but you do have to address the complaint. You may negotiate with the plaintiff, file an answer, file a motion to dismiss or sue the plaintiff.

What happens if you proceed with a lawsuit?

Opting for a settlement could provide a faster resolution, saving your company from high legal costs. However, it might suggest culpability, potentially damaging your reputation and business relationships.

If you respond to the summons by filing an answer, then the case will move forward. Before settling on this decision, it is important to consider the possible implications. Lawsuits can be an extensive process resulting in lawyer’s fees, court fees and other expenses that can easily add up. The time you spend focusing on the lawsuit could also be detrimental to your company’s bottom line. In addition, the case may invite media and public scrutiny, affecting your business’ reputation.

Still, if you are confident in your company’s position, then defending its integrity might be worth the time and expense.

Regardless of whether you have received a demand letter or a summons, it’s important to have all the information available.
