What should you do when a customer is injured on your property

On Behalf of Wilbraham, Lawler & Buba, P.C. | Apr 19, 2025 | Premises Liability

One of the common concerns of business owners is a customer being injured on their property. Premises liability cases can be serious. That’s why businesses need to keep their properties reasonably safe.

Nonetheless, despite doing your best to remove potential hazardous conditions, an accident can still happen. A customer may report being involved in a slip and fall accident or injured due to inadequate security and so forth. So, what should you do when you receive such a report?

Provide medical assistance

If the customer needs immediate medical attention, call 911. If they state they can visit the doctor after reporting, ask if they need water, ice or anything to make them comfortable.

Listen to them attentively

When the customer is informing you about the incident, listen attentively and ask relevant questions to be well-informed. It’s important to show concern and compassion. However, do not admit fault or place blame on any employee. For instance, avoid apologizing or using statements that imply such an incident has happened before.

Document the accident

Go to the accident scene to take photos and videos.  If the area has a security camera, get a copy of the footage. You should also collect witness statements.

Then, fill out the incident form, explaining the accident. Write down the personal information of the customer, the date, time and location of the incident and how it happened. This form ensures accurate documentation of the accident.

Notify your insurer

Contact your insurer as soon as possible so they can investigate the case on time.

When a customer is injured on your property, chances are they are going to file a claim against you. You need to be adequately informed to be prepared in such an instance to protect your business.
