What happens if someone has multiple asbestos exposures?

Asbestos exposure can lead to some individuals being diagnosed with mesothelioma. This is a fatal condition that often doesn’t become evident for many years after the exposure. Individuals who have this diagnosis often make legal claims to help offset their financial damages and to receive compensation for the effects of the disease.

Mesothelioma claims often involve complex legal challenges. One of these occurs when the person filing the legal claim experienced exposure to asbestos in more than one location. For companies that are defending against these claims, multiple exposure locations could be a major focus of their defense.

Identifying alternative exposure locations

There are many different situations that can lead to exposure to asbestos. In many cases, exposure comes from exercising one’s job duties. This could mean that someone exposed to asbestos worked for several job sites at which they were exposed. There’s also a chance of second-hand exposure, which is fairly common when there are multiple generations working in a profession where asbestos exposure is common.

Determining how many sources of exposure a complainant has may reduce the liability of a specific company. It’s often possible for the financial liability to be divided among multiple parties who are all found responsible, which is known as apportionment. This may be determined by a detailed review of the complainant’s employment and medical histories, along with expert testimony.

Because these cases are often intricate, it’s best for companies to work with someone familiar with defending against these claims. This can help them to learn their options and develop a defense strategy that takes various exposures – if applicable – into account.
