3 defenses if one of your trucks is in a crash

On Behalf of Wilbraham, Lawler & Buba, P.C. | Feb 7, 2025 | Trucking Defense

As a trucking company owner, you may have to deal with people coming after your business if one of your drivers has a crash. Many car drivers fail to understand just how skilled most truck drivers are. They see a big unwieldy vehicle and jump to the conclusion that the trucker must have been at fault. And that is typically when they come after your business.

Here are three possible reasons it was not your fault — or your driver’s:

1. It was the injured party’s fault

A lot of people do not like to accept responsibility for their errors. Every time they make a mistake, they look for someone else to blame. By the same token, their friends and family may have an overly positive view of them, thinking that when problems occur, it must be due to the other party, not their loved one. Just because a driver is dead or seriously injured does not mean someone else is to blame for their injuries.

2. It was another driver’s fault

Let’s say your driver or the party trying to seek compensation from you made a maneuver that led to the two vehicles colliding. It might be they made this maneuver without good reason. Or it might be they made it to avoid crashing with another driver who had just made a dangerous maneuver. That driver might have carried on down the highway unscathed without stopping. They might not even realize they caused a collision.

3. It was the fault of someone who was not present at the scene

If the crash happened shortly after you had the truck serviced by the local mechanics, you might wonder whether they did their job properly. Did they fail to replace a part properly or make some other mistake and is that the true reason for the accident?

Discovering the truth of what happened can help your business avoid taking the blame for a crash that was not your fault.
