Michael Block and John Fitzpatrick receive a Defense Verdict in a Living Mesothelioma Case

On March 12, 2012, Michael Block and John Fitzpatrick of Wilbraham, Lawler & Buba on behalf of CertainTeed Corporation received a DEFENSE verdict in Philadelphia County against the Angelos firm after 6 days of trial. The verdict was 8-0 that there was no exposure to asbestos from CertainTeed Roofing products at Bethlehem Steel. The trial judge in Philadelphia was Judge Victor DiNubile.

CertainTeed was the only defendant in the case. The Plaintiff was Gerda Haldaman, 79, who is alive and has pleural mesothelioma. She alleged that she was exposed to asbestos thru her husband, who worked at Bethlehem Steel as a carpenter. Plaintiff offered evidence from one of Mr. Haldaman’s co-workers, John Weiss who alleged exposure to CertainTeed asbestos-containing rolled roofing products. Most of the other companies that were identified were bankrupt.

Plaintiff offered evidence from Mrs. Haldaman, Mr. Weiss, Dr. Howard Kipen, from Robert Wood Johnson Hospital in New Jersey and board certified in internal and occupational medicine, Dr. Richard Kradin from Mass General Hospital, who is board certified in pulmonology and pathology. On behalf of CertainTeed we called Michael Noone, former VP of roofing at CertainTeed and a CIH, Gayla McCluskey.
